Texting or otherwise using handheld devices while driving is generally considered unsafe, even dangerous. The State of New Mexico acknowledged this threat when, in 2014, they added a section to the Motor Vehicle Code that made the practice illegal statewide. Now, The Szantho Law Firm has found that lawmakers are looking to expand on the previous efforts and reclassify using a handheld communication device while driving a serious violation for those operating commercial vehicles.

The proposed legislation, Senate Bill 428, adds both texting while driving and using a handheld mobile communication device while driving to the list of serious offenses for those driving commercial vehicles. This change would allow the state stricter enforcement options for those who are caught doing so. In addition to the fines enacted for all drivers, commercial drivers could face temporary disqualification from commercial driving if they are convicted of multiple instances within a set timeframe.
“These drivers are held to higher standards from the outset,” concludes Szantho. “They require additional training in order to handle the larger vehicles. They have to carry extra endorsements on their driver’s licenses, and they are often subject to additional road rules in order to ensure safety. Therefore it is only logical that their penalties would be more severe when dealing with such a dangerous activity as using a handheld mobile device while driving.”
