The Unlikely Link Between Bath Salts And A Brooklyn E-Cigarette Explosion Lawsuit Case

Both state and city law prohibit the sale of e-cigarettes to underage customers in New York, but that’s exactly what the 14-year-old victim says happened as he was walking through Brooklyn’s Kings Plaza mall. Now, the New York Daily News has revealed more troubling facts about the owner of Kings Plaza’s “Vape On” kiosk.

The owner of “Vape On,” the kiosk at the Kings Plaza, was arrested in 2011 by the DEA for his involvement in a Seattle-based drug ring, selling synthetic stimulants which are also known as bath salts. The kiosk owner distributed bath salts in both Manhattan and Brooklyn. Bath salts are a very dangerous drug, which enables hallucinations, seizures, and paranoia. According to Teen.DrugAbuse.com, bath salts resulted in 23,000 emergency room visits in 2011 alone.

In relation to the current lawsuit, the victim’s lawyer, Marc Freund of LipsigLawyers.com claims that the clerk at the kiosk offering e-cigarettes in Kings Plaza mall offered the product to a minor, which is illegal by both New York City and New York State laws. He also specifies that the kiosk not only offered the product to minors, and did not have proper signage but it also was owned and operated by a convicted and sentenced criminal.

Freund says, “Consumers have a right to be notified about the potential dangers of these products. We’ve found that many retailers aren’t respecting that right.”

Sadly, this is not the first e-cigarette explosion. FEMA has concluded that nearly 190 such incidents have occurred since the products hit the market in 2007. In most cases the explosion is a result of a deficient lithium- ion battery which when overheated can cause an explosion often accompanied by a simultaneous fire. In 2013 in California a woman sustained severe burns as a result of her e-cigarette exploding while charging and was granted a 1.9 million dollar award for her damages.
