Thousands Could See Their Risperdal Lawsuit Dismissed
October 28, 2016 – – There are currently thousands of lawsuits pending against Janssen Pharmaceuticals, the manufacturer of Risperdal, in Philadelphia. However, a recent ruling in a Risperdal lawsuit could mean that all these cases could be dismissed. In a Pennsylvania court of appeals, arguments have been heard from both sides in relation to how and when to apply the statute of limitations to these cases.
Janssen Pharmaceuticals manufactures Risperdal as a subsidiary of Johnson & Johnson. They feel that the statute of limitations set by a judge in Philadelphia in February 2016 should remain in place. This judge felt that patients should have known about the gynecomastia risks associated with the drug by June 2009, as it had been heavily advertised by then, as well as a label change having been put in place. According to this time frame, anyone who took the drug after that date and developed male breast tissue had until June 2011 to file a claim, as the statute of limitations would expire after that.
If this ruling is upheld, some 250 currently pending lawsuits would likely be dismissed. The plaintiffs, unsurprisingly, are contesting this. Unique circumstances have been put forward that showed the individual plaintiffs had not seen or otherwise heard of the materials that highlighted the risks.
Naturally, Janssen and Johnson & Johnson would be happy to see the lawsuits dismissed. The latest verdict against them was $70 million, and a further $6 million was added in delay damages. Both companies are fighting against the civil lawsuits against them, despite pleading guilty to illegal marketing in 2013. As a result, they had to pay the U.S. Department of Justice $2.2 billion. However, their issue is not just about the huge fines.
Consumer trust in Johnson & Johnson has been significantly eroded. The company is also facing talc powder lawsuits, and the brand has suffered. In fact, their brand score has dropped by around 66%. As such, regardless of the outcome of the fight over the statute of limitations, the damage has already been done.
