In a recent podcast episode, Jennifer Elliott, founder of San Clemente Estate Law, PC in San Clemente, CA, unveiled important tips to reduce the time and cost of going through the probate system.

When asked to comment, Elliott wanted listeners to know that because probate can be quite lengthy and costly, failing to go through the motions efficiently will result in delays and more expenses. However, there are actionable steps to take to help make probate a much more painless process.
“The first thing you can do is hire the right lawyer. Hiring the right attorney comes down to someone who is experienced. A delay in court, which could be caused by an inexperienced attorney, can lead to 3 to 6 months added onto the length of your probate. In our area, probates right now are running between 20 and 24 months anyway with no delays.”
According to Elliott, the problem comes when the family needs to continue making that payment on the house while that money is tied up in probate, an extra three-to-six-month delay will cause undue hardship on a family.
She further added that when it comes to selecting the right attorney, it’s important to ensure that they are focusing only on one area of law and not spreading themselves out too thin. If an attorney is practicing in too many areas of law, Elliott pointed out, they are likely not knowledgeable about the process and getting through it as quickly as possible.
Good communication is also essential when it comes to retaining the right legal counsel to set expectations about the probate process and avoid unnecessary costs.
When asked for an example, she said, “If you don’t have an attorney who’s a good communicator, then you could end up paying the debts of the deceased family member, such as their credit card bill. This is a mistake as you’re not supposed to pay the debts unless you have court approval. Paying that debt can actually come out of your pocket as an individual. So listening to your attorney is paramount, as is knowing which bills to pay and what not to pay.”
Elliott was quick to point out that the probate process can be avoided entirely – if the right plan is put into place.
“The most important thing I do is keep families out of court. I do that in the estate planning process. When I work with a family to put a plan in place, that is going to eliminate the need for the probate court to step in and get involved.”
