The Founding Partner of Weinman & Associates, P.C. in Austin, made a strong case this week for couples to consider a legal route with professional attorneys even if the divorce was amicable or uncontested.

A DIY divorce can undoubtedly save on legal fees, but trying to take the cheapest route to split up can often be at the expense of other matters that have either not been considered or forgotten about.

Weinman said: “A divorce attorney will often present issues and options that the parties weren’t aware of or had not planned for. The value of that advice can help avoid making costly and time-consuming errors.”

She said DIY divorces could quickly fall apart when there is disagreement over the eventual financial imbalance that is likely to occur with parties who have unequal earning capacities, or when they consider who will talk over payment of the joint debts, or when they get to discussion about child or spousal support.

“When children are involved, a couple needs to consider who the primary guardian will be, whether the children’s residence will be restricted to specific geographic boundaries, how they will share holidays and summer vacation, how school and extra-curricular activities will be handled, the amount of child support to be paid, and how they will be covered by health insurance,” Weinman elaborated.

“Family dynamics can change quickly. Often, there is little thought about how a child will cope with new spousal arrangements. Parents love to say that ‘children are resilient’, but they are not as resilient and they may appear and their parents’ divorce is likely to be one of the most traumatic events to ever occur in their lives”

That’s why a solid parenting plan should be in place to help with predictability for both parents and for the children. “Children, especially teenage children, should not be permitted to run the show and to play one parent against the other. A solid routine is critical, and both parents need to be on the same page.”

Thinking that everything, both assets and children, should be split 50-50 can often run aground quickly. That is the easiest and most peaceful way to talk about divorce, but it is generally not realistic for the long term. Even when parties are happily married, there are tasks taken on by one spouse that are not addressed by the other – there are shared responsibilities. Post-divorce, this needs to continue, but the aspect of “teamwork” will be gone, along with any trust that used to exist between them. So, responsibilities need to be very clearly delineated in a final order. Otherwise one side will end up doing the bulk of the work and the other side will get the benefit.
