Sole custody is granted to a parent when the other parent is proven to be unfit. For example, if one parent is shown to be alcohol or drug dependent or has a record of child abuse or neglect, the court may award sole custody to the other parent. However, courts in many cases avoid granting sole custody and would rather grant joint legal custody. The non-custodial parent is allowed to visit regularly and both parents share in the decision-making process for the child. In joint custody arrangements, the parents will need to develop a schedule depending on the child’s needs and on their work and housing arrangements. If the parents are unable to come up with such a schedule, the court will provide for an arrangement. What is usually done is to divide the weeks spent by the child in each parent’s home. There are other kinds of joint custody arrangements. One is where the child switches between the parents monthly, half-yearly, or yearly. Another possible arrangement is where the child stays with one parent during holidays and weekends while staying with the other parent on weekdays.

Technically, there are different kinds of joint custody, based on how the separated or divorced parents share the role of decision making for the child, and/or physical control and custody of the child. The type of custody can be joint physical custody, joint legal custody, or joint legal and physical custody.

Another kind of joint custody arrangement is called the “bird’s nest custody” or “nesting.” Here, the child stays at the family home while the parent take turns in moving in and out of the home. Each parent that is not in the family home at a particular time stays at his or her own separate housing.
