The spousal maintenance that is awarded by a court at the time of divorce can be in one or a combination of ways. These include permanent spousal maintenance, lump-sum spousal maintenance, temporary spousal maintenance, and rehabilitative spousal maintenance.

According to Top Law – Family Lawyers, permanent spousal maintenance is paid until the death of the payer or when the recipient has remarried. A “cohabitation” clause could be added to this agreement such that the alimony will end when it has been determined that the recipient has been cohabitating with someone as an attempt to avoid remarriage.

In the lump-sum spousal maintenance, it is settled in just one payment. It should be noted that just like other spousal maintenance, this lump-sum amount is taxable. Thus, it is important to consult with a CPA experienced in divorce to fully understand the tax implications of the lump-sum spousal maintenance agreement.

A temporary spousal maintenance arrangement may be ordered when the financial status of the divorced spouses is almost equal but one one spouse may just need some temporary assistance for a period of about one to two years.

And finally, there is the rehabilitative spousal maintenance arrangement. This is the most common type of arrangement for spousal maintenance and is often awarded when the recipient is young or will eventually be able to return to the workforce and be able to support herself. This may include education payments that may be needed for the recipient to become self-supporting.

Courts will take into consideration a number of factors when determining the need for spousal maintenance. These include the length of the marriage; income and liability status of each spouse; the ages and the physical, emotional, and mental states of each party; the current and potential earning capacities of both spouses; other sources of income including but not limited to dividends and interest; the economic needs of each spouse; the standard of living of both spouses during the marriage; child care and child support obligations; the potential of each spouse to acquire more assets and income; the time needed for a recipient of spousal maintenance to acquire more education in order to be gainfully employed; the contribution of one of the spouses for the education and furtherance of the other’s career; the contribution of one of the spouses as a homemaker; and how much the earning power of the custodial parent will be affected by parenting requirements.
