When asked for a comment, she said, “Dissolving a marriage is much more complicated than a simple breakup. It’s better to have a solid plan and strategy when exiting a marriage. Here are some things to do to ensure that you are prepared.”

One of the first things to do early on in the divorce process is to paint a financial picture, including all assets and debts.

“One of the main aims of divorce is to divide assets and debts, so it’s vital to get a good grasp of yours and your spouse’s financials. You should map out your marital assets such as your house, financial and retirement accounts, vehicles, businesses, intellectual property, etc. that can be split equitably. It’s also important to gather documentation of other assets that were owned by you or your spouse before the marriage, and anything inherited by you or gifted to you,” she said.

Weinman further added that the best way to pinpoint all marital debt is by obtaining a copy of a credit report, which will list any shared debt.

“As part of gathering this documentation, it’s also crucial to get ahold of proof of income for both you and your spouse. If both of you are salaried employees, then this can be as simple as getting the most recent pay stubs and income tax returns,” she said.

Carefully looking over any joint financial accounts can avoid problems down the line.

When asked to elaborate, she said, “If divorce proceedings become contentious, a spouse might try to clear joint financial accounts. If you think this might be the case, then you can open an account that is only in your name and transfer half the funds from the old account to the new one. However, before following through with this, make sure to speak with an attorney.”

Retaining a divorce attorney who is a right fit can go a long way in smoothing the divorce process.

“It’s not always possible to come to a fair and reasonable settlement during the divorce process without litigation – if that’s the case, then you need a competent attorney who can assist you with negotiation, mediation, or potentially argue your case to a court on your behalf,” she said.

When asked what to look for in an attorney, Weinman said, “What you’ll want to look for is someone with whom you feel a personal connection, who will be solidly in your corner and wants to settle early on as opposed to dragging the divorce out longer than it needs to be. You don’t need to hire the first attorney you speak with – instead, consult with at least three and make sure they have at least 5 years of experience in family and divorce law.”
