U.S. District Judge Rules Pennsylvania Lawsuit Regarding Talcum Powder May Proceed

According to news sources, District Judge Mark A. Kearney ruled in October that a Pennsylvania case against talc powder producer, Imerys, and supplier, Johnson & Johnson may proceed. The case is in regard to a woman who allegedly died after being diagnosed with ovarian cancer that is believed to be caused by the companies’ talcum powder products. Additionally, the case draws attention to the fact that no warnings about the alleged dangers were placed on the product.
Talcum powder’s alleged link to ovarian cancer has been the source of many lawsuits that have been filed against Johnson & Johnson. The lawsuits, which now reach over 2,000 in number suggest that plaintiffs have used their powders and subsequently developed the deadly disease. Plaintiffs argue that the company should be held responsible for charges including fraud and negligence for failing to warn consumers about these alleged risks.
Johnson & Johnson has denied such claims, stating that their products were developed by “following the science” and that no such link exists. Juries, however, have found that the pharmaceutical giant should be held responsible and the company has been made to pay millions in the three trials that have since concluded. Johnson & Johnson is looking to appeal those decisions.
