Underage Alabama Teen Burned By E-Cigarette Explosion, E-Cig Explosion Lawsuit Likely To Follow

June 19, 2016 – – LipsigLawyers.com’s Marc Freund referenced a recent development in Albertville High School in Alabama when emphasizing the potential consequences that e-cigarettes can have on users. Attorney Marc Freund stated that “Consumers have a right to be notified about the potential dangers of these products. We’ve found that many retailers aren’t respecting that right.” Freund also notes that typical injuries from e-cigarette explosions include, severe burns, cuts, and in some cases impaired vision, the need for surgery, and loss of limbs.

As indicated in the local news report from AL.com, an Albertville 10th grader was carrying an e-cigarette in his pocket when the battery unexpectedly started heating up. The student felt the burning and quickly moved the device onto a desk. Regrettably, the e-cig then exploded, and shot across the room striking another boy leading to hospitalization.

The school district superintendent signaled that “People need to know these are dangerous. Don’t bring them into schools.” This case is also significant due to federal law and Alabama state law, which explicitly prohibit the sale of tobacco to minors.

There has been a multitude of e-cigarette explosions since the products were introduced to the public in 2007. Since August of 2009, TheProductLawyers.com reports that there have been 196 reports of exploding e-cigs. The most recent case occurred on June 8th when an Oklahoma man was injured by an exploding e-cigarette causing facial disfigurement and visual impairment. The Oklahoma man has since filed a lawsuit, claiming that the retailer who sold him the device was negligent.
