With Bellwether Selection Complete, Xarelto Lawsuit Cases Move Closer To Court Dates

June 30, 2016 – – TheProductLawyers.com offers insight on the progress of the nearly 3,000 lawsuits against the manufacturers of the drug Xarelto—Janssen Pharmaceuticals (a branch of Johnson & Johnson Corporation) and Bayer AG. Late last year, the U.S. Judicial Panel on Multidistrict Litigation announced that, in response to a petition for consolidation, it would create a multidistrict litigation (MDL) 2592.

Additionally, the JPML stated that any subsequent, closely-related suits brought before a federal court would be merged with the MDL. Concerns over the prudent allocation of resources, both public and private, further spurred the JPML to appoint Judge Eldon Fallon to preside over the litigation in the Eastern District of Louisiana.

According to plaintiff claims, taking the anticoagulant exposed them to an elevated risk of suffering a catastrophic bleeding episode. This allegation is shared in common by the many plaintiffs of the MDL. In many cases the plaintiffs allegedly suffered from uncontrollable bleeding in which immediate and invasive intervention was needed to prevent fatalities which reportedly did occur in some cases.

In the interest of conserving time and resources, Judge Fallon issued a court order on December 17th, 2015. Lawyers for both the plaintiffs and the defendants were instructed to select ten cases from the MDL plaintiffs. These must be trial ready, and must originate from the 10 states with the most claims. The court would select twenty such cases and merge them with the lawyers’ choices.

These forty cases formed a trial pool for the selection of four bellwether cases. With initial selection complete by January 11th, 2016, further refinement of the bellwether lawsuits could proceed.
