Xarelto Lawsuit Cases Consolidated By JPML

June 06, 2016 – – TheProductLawyers.com reports on the immense number of cases being filed against Bayer AG and Johnson and Johnson Corporation subsidiary Janssen Pharmaceuticals related to Xarelto. The anticoagulant has been alleged to have caused instances of uncontrolled and very dangerous bleeding in patients using it. Resulting from the large number of cases, a group of plaintiffs that had filed individual lawsuits petitioned the U.S. Judicial Panel on Multidistrict Litigation (JPML) in October 2015 to consider consolidating the cases since all of the 2,800 or more of the suits filed involved the same defendants and very similar allegations about the drug.

The petitioners asked that all the cases involved be under the jurisdiction of a court in the Southern District of Illinois. However, the defendants in the case argued against this move since they were located in New Jersey and felt it would be more prudent to have them assigned to a New Jersey court.

In a decision handed down on December 12, 2015, the judicial panel agreed with the petitioners and opted to consolidate and centralize all the bleeding cases involving Xarelto to the Honorable U.S. District Court Judge Eldon E. Fallon in the Eastern District of Louisiana. The panel expressed its confidence in Judge Fallon to prudently and effectively oversee the consolidation of MDL 2592.

The JPML felt that having each case heard individually would only serve to increase the amount of time spent by those parties involved in the cases as well as the legal expenses that would be incurred. The panel also felt such a consolidation would reduce the lengthy and sometimes very expensive discovery processes.
