Xarelto Lawsuit Cases Undergo 2017 Bellwether Trial Preparations For Multidistrict Litigation Number 2592
April 18, 2016 – – BloodThinnerHelp.com reports on details of current bellwether trial preparations for more than 2,800 federally-filed Xarelto lawsuits which were transferred to a single court by the U.S. Judicial Panel on Multidistrict Litigation, and consolidated to form MDL number 2592. Consolidated lawsuits share striking similarities, naming the same defendants and discussing common side effect claims. Those involved generally allege that new-generation blood-thinning drug Xarelto places those using it at heightened risk for the development of sudden and dangerous bleeding events. In some cases, according to current plaintiffs filing suit for loved ones who have passed away, these bleeding episodes can prove to be fatal.
Xarelto lawsuits in MDL 2592 continue to get closer to bellwether trials, currently scheduled for early 2017, and as they do, they continue to grow in number. They are centralized in the U.S. District Court of Eastern Louisiana and are being overseen by the Honorable Judge Eldon Fallon. Details found within a court order from Judge Fallon on December 17th, 2015 indicated that the process of choosing 40 lawsuits from the thousands in the MDL to form a bellwether trial pool was underway. In this order, both plaintiffs and defendants were asked to each choose 10 representative cases to accompany another 20 randomly chosen by the court, making up a bellwether pool. The deadline given for this process was January 11, 2016. Judge Fallon noted at this time that the court would have selected their 20 random cases by January 15, 2016, and that later, from the bellwether pool of 40 cases, 4 representative cases would be chosen to be heard in 2017 bellwether trials.
Judge Fallon also provided details on different categories that each of the chosen lawsuits should fit into. He asked that these categories include: patients taking Xarelto who had suffered from a gastrointestinal bleeding event, a brain hemorrhage, and rectal bleeding while using the blood thinner to prevent a stroke, as well as patients who had taken Xarelto and suffered from gastrointestinal bleeding events, brain hemorrhages, or rectal bleeding while using the blood thinner to prevent the occurrence of deep vein thrombosis (DVT) or pulmonary embolism.
Xarelto lawsuits have been filed against Bayer AG and Johnson & Johnson subsidiary Janssen Pharmaceuticals. Many involved believe that there is still plenty of time for additional lawsuits to be filed, and compare the blood thinner controversy to previously settled cases filed against Pradaxa.
