Xarelto Lawsuit Consolidation Update

May 23, 2016 – – TheProductLawyers.com reports on more than 2,800 federal lawsuits focusing on Xarelto, a new-generation blood-thinning drug. The suits have been brought against Janssen Pharmaceuticals, a subsidiary of Johnson and Johnson Corporation, and Bayer AG, the manufacturers of Xarelto. Plaintiffs in all of these cases in the MDL are claiming that the drug caused uncontrollable bleeding in those who took the drug and was fatal in many instances.

It should be noted that these 2,800 cases were consolidated together by the U.S. Judicial Panel on Multidistrict Litigation (JPMDL) numbered as 2592 under the jurisdiction of a federal court in Louisiana. The panel consolidated them because the allegations about the drug in regard to excessive bleeding were strikingly similar and all were filed against the same defendants. The consolidation was also done since it would facilitate the fast-tracking of the litigation, save on discovery costs, as well as the time and money of those involved in litigating all the cases separately.

The multidistrict litigation (MDL) has been inching forward toward its day in court, with the selection of bellwether trial selections being made. These cases were reviewed at a monthly status conference at the end of February 2016.

Along with the MDL, there are an additional 550 cases being litigated as a mass tort program in Philadelphia, PA and were consolidated by the Court of Common Pleas.

One case, in particular, was filed in a federal court in Vermont by a woman on behalf of her father who died while taking Xarelto. It was initially filed with number 2:14-cv-00159-cr. The plaintiff claims in her court papers that her father suffered a parenchymal hemorrhage at the time he was taking Xarelto, otherwise known as a brain bleed. Doctors could not clot his blood since Xarelto’s purpose is to thin the blood, thus making the bleeding in this case fatal.
