Xarelto Lawsuit: Daughter Alleges Drug Caused Parenchymal Hemorrhage Resulting In Father’s Death
June 11, 2016 – – TheProductLawyers.com reports on a Xarelto lawsuit related to the death of a patient who suffered a parenchymal hemorrhage, otherwise known as a brain bleed. The lawsuit was filed by the patient’s daughter on behalf of the deceased and claims that her father’s death was precipitated by the use of Xarelto, which he was taking at the time of his death. Xarelto’s purpose is to thin the blood to prevent blood clots or stroke and has been alleged to cause uncontrollable bleeding. In this case, it is claimed that doctors were unable to clot the man’s blood which thus caused his untimely demise.
Since its release on the market, Xarelto has become the focus of thousands of lawsuits currently in excess of 3,000 and have been filed against the drug’s manufacturers, Bayer AG and Janssen Pharmaceuticals, the former of which is a subsidiary company of the Johnson and Johnson Corporation. Of these 3,000+ cases, over 2,800 have been consolidated as per a decision by the U.S. Judicial Panel on Multidistrict Litigation (JPML). The defendants named in all of these cases are Bayer and Janssen and the allegations in each are very similar in that the plaintiffs allege that Xarelto can cause uncontrollable bleeding episodes that result in long-term health conditions and in many instances death. The consolidation of these cases will allow a more streamlined litigation process and save time and money of those involved in preparing and bringing the trials to fruition. It will also prevent multiple rulings by different judges, as well as duplication of discovery processes.
The multidistrict litigation (MDL) has been assigned number 2592. The cases in the MDL have incrementally progressed where bellwether trials have been selected. It should also be noted that 550 or more cases have grouped together in a mass tort program in Philadelphia, PA in addition to the cases in the MDL.
