Xarelto Lawsuit Plaintiffs Find Increasing Support From The Public As Lawsuit Filings Mount
June 25, 2016 – – TheProductLawyers.com reports on the agglomeration of the recent cases against Janssen Pharmaceuticals (a division of Johnson & Johnson) and Bayer AG in relation to the drug Xarelto. More than 3,000 separate cases were filed alleging harm or undue risk of harm as a result of taking the anticoagulant.
Due to the steady accumulation of similar complaints against the drug, the U.S. Judicial Panel on Multidistrict Litigation combined 2,800 cases to form multidistrict litigation (MDL) case No. 2592, which will be tried in the Eastern District of Louisiana. A similar combination has occurred in Philadelphia, Pennsylvania. Here, the Court of Common Pleas has combined cases into a mass tort program, comprised of over 550 separate lawsuits. Because of the highly public nature of the established suits, it is expected that individuals who suffered similarly as a result of the drug will continue to come forward.
In 2011, the FDA granted approval for the sale of the new-generation anticoagulant. Because it acted to prevent clotting in the bloodstream, the drug was prescribed to patients who suffered from deep vein thrombosis or pulmonary embolism and those in recovery from recent knee or hip replacement surgery. At a later time, it was also applied to the cases of individuals who suffered from atrial fibrillation, a heart condition known to increase the potential for strokes.
Both the combined litigation groups have put forth the claim that because the manufacturers neglected to properly warn potential patients and physicians about the possible elevated risk for the occurrence of sudden dangerous bleeding episodes in patients taking the anticoagulant.
Similar events surrounded the drug, Pradaxa, which was also an anticoagulant. The plaintiffs take comfort in the knowledge that several thousand lawsuits were filed against the drug companies, all of which were settled before proceeding to trial.
