Xarelto Lawsuit Plaintiffs Note Fault In Drug Advertising
May 23, 2016 – – TheProductLawyers.com reports on Xarelto and the many ads promoting the drug using popular athletes and celebrities such as NASCAR great Brian Vickers, golf legend Arnold Palmer, NBA player Chris Bosh, and Saturday Night Live’s Kevin Nealon. In one particular commercial, all of the cited celebrity individuals are talking about the benefits of Xarelto while playing a round of golf. Plaintiffs have noted that they fail to sufficiently mention in the ads the numerous concerns that many patients have with the drug and the risks associated with using it.
Many plaintiffs in the numerous lawsuits filed since the drug was released on the market have a very different view of the anticoagulant than those being expressed in the celebrity commercial. Plaintiffs find it disconcerting that they and many others have been put at an increased risk of experiencing potentially life-threatening uncontrollable bleeding that can lead to death in the extreme case.
Due to this alleged risk and the marketing methods used, there have been in excess of over 2,800 lawsuits filed against the makers of the drug, Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation, and Bayer AG, with more expected to be filed. These cases come from all across the United States and have been consolidated into a comprehensive multidistrict litigation (MDL), number 2592. The MDL is being overseen by the Honorable Judge Eldon Fallon of the Eastern District of Louisiana.
It should be noted, that since its initial approval of the drug, the U.S. Food and Drug Administration (FDA) has given the new-generation blood thinner two black box warnings. A black box warning is the harshest warning that the FDA can give a product before it is ordered off the market completely.
