Xarelto Lawsuit Update: Plaintiffs Claim Marketing Tactics Are Deceptive
June 12, 2016 – – TheProductLawyers.com reports on Xarelto and the many ads promoting the drug using popular athletes and celebrities such as NASCAR great Brian Vickers, golf legend Arnold Palmer, NBA player Chris Bosh and Saturday Night Live’s Kevin Nealon. In this particular commercial, all of the cited celebrity individuals are talking about the benefits of Xarelto but they fail to sufficiently the numerous concerns that many patients have with the drug and the risks associated with using it.
Many plaintiffs in the numerous lawsuits filed since the drug was released to the market have a very different view of the drug than those being expressed in the commercial. A good number of those pursuing legal action against the makers of Xarelto find it disconcerting that they and many others have been put at an increased risk of experiencing potentially life-threatening uncontrollable bleeding that can lead to death in the extreme case.
There have been in excess of over 2,800 lawsuits filed against the makers of the drug, Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation, and Bayer AG, with more expected. These suits all similarly allege that the drug puts users at an increased risk for uncontrollable bleeding episodes. These cases come from all across the United States and have been consolidated into a multidistrict litigation (MDL) number 2592. The MDL is being overseen by the Honorable Judge Eldon Fallon in the Eastern District of Louisiana.
It should be noted, that since its initial approval of the drug, the U.S. Food and Drug Administration (FDA) has given the new-generation blood thinner two black box warnings. The black box warnings are the harshest warnings that the FDA can give a product before it is ordered off the market completely.
