Xarelto Side Effects Lawsuit Update: 1st Trial Location Set

August 18, 2015 – – BloodThinnerHelp.com reports that the bellwether trials for Xarelto lawsuits will take place as early as August 2016. The bellwether trials will be heard by U.S. District Judge Eldon Fallon in the Eastern District of Louisiana. These specific cases are a part of the federal Xarelto multidistrict litigation, or MDL. At this point, about 550 cases are filed in the MDL as product liability complaints alleging that Xarelto caused individuals a variety of bleeding problems.

“Now that there is a time frame for the bellwether trials, we are expecting more and more cases to come forward,” Xarelto attorney Marc Goldich said.

The bellwether cases are meant to help both parties involved in the lawsuit see how evidence and testimonies that will be presented in the litigation will effect the jurors and how they will respond to it. The results of these trials may not effect the other trials in the MDL, as the point of an MDL is to allow each case to be tried individually. The presiding Judge, Judge Eldon Fallon, has recommended that 50 cases be initially selected for the bellwether cases and at the recommendation of the court, the first two trials will be heard in the Eastern District of Louisiana, the third in the South District of Texas, and the fourth in the Southern District of Mississippi.

Xarelto Alleged to Cause Adverse Side Effects:

The anticoagulant Xarelto was initially developed to treat deep vein thrombosis and reduce the risk of stroke and blood clots in patients. It is commonly prescribed to patients who have recently undergone a knee or hip replacement surgery.
Xarelto works differently than other blood thinners because it blocks the enzyme in the blood that is responsible for all blood clotting function, thrombin.

By blocking thrombin, Xarelto is exponentially more dangerous than other blood thinners because there is no known antidote to the drug. In emergency situations where a patient experiences internal bleeding but is on a blood thinner such as Warfarin, a doctor can administer Vitamin K to counteract the effects of Warfarin and the blood will clot. These historic antidotes do not work with Xarelto and currently the drug does not have an antidote.

The lack of antidote and risk for severe uncontrollable internal bleeding has caused a variety of adverse events in its users including stroke, hemorrhage, gastrointestinal bleeding, and pulmonary embolism.

Allegations of Xarelto Lawsuits:

The Xarelto lawsuits that are involved in the MDL all involve similar allegations against the drug’s developers, Janssen Research and Development, a branch of the company Johnson&Johnson, and Bayer Pharmaceuticals. Plaintiffs allege that these companies failed to provide adequate warnings about the dangerous adverse events that Xarelto can cause.

Like all anticoagulants, the Xarelto label contains warnings about the medication’s potential risk of bleeding events, but the lawsuits allege that the information provided is insufficient and fails to convey the serious and potentially deadly nature of the medication’s side effects.
