Zofran Birth Defect Lawsuit Attorneys Release Video Answering Critical Questions

November 13, 2015 – – ZofranLegal.com announces the release of a new video designed to help those looking into filing a lawsuit regarding the drug. The video answers two of the most commonly heard questions regarding Zofran litigation: how to file a Zofran lawsuit and how much the process costs. As these lawsuits continue to rise in number, the attorneys at Monheit Law felt that it was an ideal time to get this information out to the public.

Common allegations made in lawsuits against GlaxoSmithKline, manufacturer of the anti-nausea medication Zofran, complain that expectant mothers who used the drug to combat morning sickness and therefore exposed their babies to it in utero, later gave birth to babies who had developed a variety of birth defects. Defects most commonly alleged include cleft lip and palate, atrial septal defect and ventricular septal defect, transposition of the greater vessels, kidney defects, clubfoot, and tetralogy of fallot.

Lawsuits included in MDL 2657 now number over 60, and range in severity of defects described, some of which were fatal. Nearly every child involved, however, required multiple corrective surgeries for their defects according to parents. Details note that the drug was typically prescribed during the first trimester when many expectant mothers experience the worst morning sickness. This is coincidentally also the time when the fetus undergoes most of its mouth, limb, and heart development.

One common factor noted in allegations is that the drug was never FDA approved to treat pregnant mothers for morning sickness. It was approved to treat individuals battling nausea and vomiting episodes after undergoing chemotherapy, radiation, and anesthesia procedures. After this approval, however, GlaxoSmithKline allegedly marketed the drug to OB/Gyns across the U.S., causing the medication to be prescribed “off-label” to this group of consumers.

Nationally, the medication has been prescribed to countless pregnant women since the early 90’s. Now, the lawsuits associated with the product are beginning to add up. The current MDL will be overseen by the Honorable Judge F. Dennis Saylor. It is fully expected that additional suits will continue to appear, which is why Monheit Law is working to release these informative videos.
