Zofran Lawsuit Judge F. Dennis Saylor IV Allows Direct Filing In Boston Multidistrict Litigation
January 08, 2016 – – ZofranLegal.com reports on a recent order by Zofran MDL Judge F. Dennis Saylor IV which should aid in simplifying the process involved in filing Zofran-related congenital birth defect lawsuits. The Honorable Judge has announced that those filing Zofran lawsuits can now do so directly within the current MDL, to join the other cases consolidated there. The MDL consolidation was ordered by the U.S. Judicial Panel on Multidistrict Litigation and is intended to fast-track the legal process by avoiding duplicate discovery and different rulings by multiple judges. Additionally, the consolidation conserves time and finances for those involved.
Lawsuits consolidated in the MDL are located in Boston, Massachusetts and currently number over 160. With this new ruling, instead of requiring that plaintiffs initially file in the federal court of their own states before their case is transferred to join those in the MDL, people will now be allowed to directly file on the MDL docket, greatly simplifying their filing process.
This new order is the sixth provided by Judge Saylor, and should greatly help with future Zofran lawsuits which are expected to continue to increase in number as time passes. Lawsuits which are consolidated in the MDL are filed against defendant GlaxoSmithKline, the manufacturer of anti-nausea drug Zofran. The suits similarly allege that exposure to the drug while growing in utero causes fetuses to develop severe and sometimes fatal congenital birth defects. Birth defects named include clubfoot, congenital heart defects, respiratory defects, kidney defects, and cleft lip and palate.
