Zofran Lawsuit MDL 2657 Overseeing Judge F. Dennis Saylor IV Allows Direct Filing

March 30, 2016 – – ZofranLegal.com reports on the details of a recent order made by Judge F. Dennis Saylor IV concerning MDL Number 2657, which is made up of consolidated and transferred Zofran birth defect lawsuits. The judge is currently overseeing these cases in Boston, Massachusetts. His direct filing order should significantly simplify the lawsuit filing process for others looking join the current MDL by filing their own Zofran birth defect lawsuit against the drug manufacturer GlaxoSmithKline. The judge has indicated that those filing future Zofran lawsuits will be able to file directly into the MDL instead of filing in each of their individual states first and then waiting for their lawsuit to be transferred to Boston.

Plaintiffs currently filing lawsuits in the MDL will join hundreds of other plaintiffs who have filed similar lawsuits, which have been consolidated there by the U.S. Judicial Panel on Multidistrict Litigation. The consolidation is formed in order to help the legal process run more efficiently, avoiding different rulings from several judges, and prevent duplicate discovery. It also helps to conserve the resources of everyone involved.

Currently consolidated lawsuit complaints have been filed by plaintiffs from across the nation who share common allegations against defendant GSK. They unanimously allege that fetal exposure to Zofran through the mothers can cause babies in utero to develop severe and possibly fatal birth defects. Many of the plaintiffs are mothers who were prescribed the drug as a treatment for morning sickness while pregnant, a use which GSK advertised it to do but which it was never FDA-approved for, and who subsequently gave birth to children with severe defects. Some of the families involved report that their children have passed away due to their defects, while others reported that their children required several corrective surgeries which were both risky and expensive. Birth defects most commonly named by Zofran lawsuit plaintiffs include cleft lip and palate, respiratory defects, transposition of the greater vessels, clubfoot, atrial septal defect, ventricular septal defect, and kidney defects.
