Zofran Lawsuit Plaintiffs Offer Support To Other Parents

March 28, 2016 – – Zofranlegal.com has reported that the parents involved in the ever growing Zofran litigation have offered their support to another group of plaintiffs who recently filed lawsuits in St. Louis, alleging that the anti-seizure medication Depakote caused birth defects in an unborn child.

The similarities between these two groups are striking and parents who have filed a Zofran birth defect lawsuit certainly know how upsetting it can be to know that a drug may have lead to a severe birth defect in their child. In the more than 230 lawsuits filed against the manufacturers of the anti-nausea medication Zofran, GlaxoSmithKline, parents claim that the drug caused a cleft lip, cleft palate, ventricular septal defect, atrial septal defect, clubfoot, kidney defect, or respiratory distress syndrome in a baby after the mother was prescribed the drug to treat morning sickness.

Parents are also alleging that the company unlawfully promoted the drug for off-label use, leading millions of mothers to believe that the drug was safe to take during pregnancy. As the complaints point out, the drug was never approved by the FDA for the treatment for morning sickness or for expectant mothers. In fact, the drug is supposed to be given to patients undergoing treatments involving chemotherapy, radiation, and anesthesia to treat their nausea and vomiting.

The U.S. Department of Justice apparently agreed with these plaintiffs because they pursued their own lawsuit against GSK, also alleging that the company had advertised several drugs for off-label use, including Zofran. The company never formally admitted to any wrongdoing, however, they did agree to a settlement which included nearly 3 billion dollars in fines.

Federally-filed Zofran lawsuits have been consolidated into MDL 2657. Both the plaintiffs and the defendant were excited about the consolidation as it will prevent duplicate discovery and save all parties time and money.
