Zofran Lawsuit Plaintiffs Report Doctors Are Still Prescribing The Drug To Pregnant Women

April 06, 2016 – – Zofranlegal.com has reported that the plaintiffs involved in the ever growing Zofran litigation are upset that the drug is still being prescribed to expectant mothers by their doctors.

There are now more than 230 families that have pursued legal action against the manufacturers of the anti-emetic drug, GlaxoSmithKline. Each lawsuit alleges that the company advertised the drug for “off-label” use, which resulted in doctors throughout the country prescribing it to millions of pregnant women as a treatment for morning sickness. Plaintiffs further allege that when an unborn baby is exposed to the drug while in the womb, this exposure results in an increased risk for birth defects. In each complaint filed, the parents claim that this exposure has caused their child to suffer due to a birth defect.

Birth defects noted by plaintiffs include cleft lip, cleft palate, atrial septal defect, ventricular septal defect, clubfoot, kidney defects, ear deformities, and respiratory distress syndrome. Nearly every child who has been diagnosed with one of these conditions has been forced to undergo a corrective surgical procedure and, in some cases, the defect proved to be deadly.

Plaintiffs are not denying that the drug is an effective treatment for nausea and vomiting, however, they continually point out that Zofran was never approved for pregnant women and their unborn children. The drug was, in fact, only approved for patients who were suffering after undergoing chemotherapy, radiation, or anesthesia. Despite this fact and the ongoing lawsuits, OB/Gyn’s are still prescribing the drugs to mothers today. Unfortunately, it is still legal for doctors to prescribe a drug “off-label”, even if it is unlawful for companies to promote their drugs for “off-label” use.

This isn’t the first time that GSK has faced a lawsuit regarding the way it promotes its drugs. The United States Department of Justice filed a lawsuit against the company alleging that they had unlawfully promoted the use of several of their drugs “off-label”, including Zofran. The company ultimately ended up paying nearly three billion dollars in fines after they agreed to a settlement in 2012.
