Zofran Lawsuit Plaintiffs Submit Proposal Detailing Dateline For Master Pleadings Submission
April 01, 2016 – – ZofranLegal.com reports on an update to the current Zofran lawsuits. It was reported that on March 11th of 2016, involved plaintiffs submitted their proposal regarding the sequence and effect of “Master Pleadings.” According to the American Association for Justice, Master Pleadings are written documents which are drafted for administrative purposes, while “Master Complaints” combine the allegations and details listed in individual lawsuits into a single document.
The document is meant to provide a complete list of the reasons each involved party has chosen to file a lawsuit and to combine any relevant and important supporting information. In response, it is typical for the defendants in a trial to draft a “Master Answer” to the listed claims. In this document, they are able to argue facts listed by the plaintiffs.
Much was learned from recent plaintiff documentation. They intend to file their Master Complaint by April 14th of 2016, and, before this date, they will additionally serve defendant GlaxoSmithKline with their Short Form Complaint. They are requesting any edits to the documentation from the defendant by May 3rd of 2016, and, finally, GSK will respond with its Master Answer by May 17th of 2016.
The consolidated and transferred Zofran lawsuits have been formed into MDL number 2657 by the U.S. Judicial Panel for Multidistrict Litigation. They were able to be consolidated as they involved strikingly similar allegations concerning fetal exposure to anti-nausea drug Zofran and the development of birth defects. In addition, lawsuits were similarly filed against defendant GlaxoSmithKline, who manufactures the drug. The MDL is said to include over 200 lawsuits from plaintiffs across the nation.
