Zofran Lawsuits Connect Anti-Nausea Drug To Birth Defects

November 24, 2015 – – ZofranLegal.com reports on a surge of recent birth defect lawsuits which allege that exposure to anti-nausea medication Zofran by babies growing in utero can cause them to devevlop birth defects. As these lawsuits increased in number, the U.S. Judicial Panel on Multidistrict Litigation consolidated them to form an MDL which is being overseen by Honorable Judge F. Dennis Saylor in Boston, Massachusetts.

The lawsuits have been filed by parents of babies born with serious birth defects after their mothers were prescribed Zofran while pregnant to treat morning sickness. They commonly allege that manufacturer GlaxoSmithKline promoted the drug for unapproved uses and didn’t warn about risks linking the medication to birth defects.

In 1991, the United States Food and Drug Administration approved GSK’s Zofran to treat nausea and vomiting episodes experienced by those who recently underwent chemotherapy, radiation, or anesthesia. The drug however, was never approved or tested for safety on pregnant women. Despite this fact, GSK allegedly marketed the drug “off-label” as a treatment for morning sickness to the general public and OB/Gyns across the nation. Since this promotion, Zofran has been prescribed to an estimated 1 million pregnant women annually.

Since the formation of the Zofran MDL, cases have continued to increase in number. This year, hundreds of families stepped up filing lawsuits across the U.S., and at this time, over 100 of them have been consolidated in the Boston MDL. Defects most commonly mentioned in the suits include cleft lip and palate, atrial septal defect and ventricular septal defect, transposition of the greater vessels, tetralogy of fallot, clubfoot, and kidney defects.
