Zofran Lawsuits In MDL Consolidation Number 204

November 24, 2015 – – ZofranLegal.com reports on Zofran lawsuits currently consolidated in a U.S. District Court in Boston, Massachusetts, which now number 204. The suits have been filed against pharmaceutical giant GlaxoSmithKline, and similarly allege that anti-nausea drug Zofran causes birth defects when exposed to developing fetuses.

The surrounding litigation, which started over 9 months ago, has seen a recent surge in public interest. Much discussion has surrounded the upcoming transfer of all Zofran cases to Boston, under MDL number 2657. It is expected that pre-trial proceedings for these cases will begin in the near future.

Zofran is an anti-nausea medication which was approved by the U.S. Food and Drug Administration to treat nausea in cancer patients after chemotherapy or radiation therapy, or to treat nausea in patients who recently underwent anesthesia for surgery. After this approval, however, GSK went on to market the drug as a treatment for morning sickness to OB/Gyns and the general public. This is what is termed “off-label” marketing, and is a large part of allegations within the lawsuits.

The families who are plaintiffs in these cases allege that the mother’s use of Zofran while pregnant subsequently caused their children to develop serious birth defects while in utero. Zofran was never FDA-approved or tested for safety on expectant mothers. The defects most commonly alleged that Zofran has caused in infants are: cleft lip and palate, atrial septal and ventricular septal defect, transposition of the greater vessels, tetralogy of fallot, kidney defects, and clubfoot. Some plaintiffs have infants who have died due to their defects.

Today, there are other families who may still be eligible to join the current Zofran lawsuits.
