Xarelto Lawsuit Cases Progress After Formation Of MDL

July 03, 2016 – – TheProductLawyers.com announces recent developments in the multidistrict litigation (MDL) 2592 against Xarelto and its manufacturers, Bayer AG, and Janssen Pharmaceuticals. Originally, more than 2,800 individual lawsuits alleged undue risk of injury associated with taking the new-generation anticoagulant and sought damages from the companies responsible for its creation and distribution.

Late in 2015, lawyers for the plaintiffs sought a consolidation from the U.S. Judicial Panel on Multidistrict Litigation (JPML), which was granted in December. In the interest of conserving time and resources of all parties, expediting the process of justice, and avoiding complications associated with multiple rulings from different courts, the JPML issued its decision. They appointed Judge Eldon Fallon to preside over the mass litigation in the Eastern District of Louisiana.

Even though the U.S. Food and Drug Administration passed approval for the new-generation anticoagulant in 2011, the outlook for Xarelto’s success has grown increasingly dim. Within only five years, the FDA has issued two black box warnings against the drug, which is the most severe warning a product can receive prior to being removed from the market.

Initially, the anticoagulant was approved for treatment of pulmonary embolism and deep vein thrombosis, and as a clotting preventative for individuals recovering from knee or hip replacement surgeries. Soon afterward, it was also approved for use as a stroke preventative for patients who suffered from atrial fibrillation, a common cardiac condition. Individuals have since filed suits against the drug manufacturers claiming that it exposed them to a heightened risk of catastrophic bleeding episodes. These claimants also assert that the companies who manufacture and distribute the drug were negligent in their duty to suitably warn patients and doctors of these potential risks.

In addition to those represented by MDL 2592, a mass tort program made up of 550 individual cases has been consolidated by the Philadelphia Court of Common Pleas. As MDL 2592 cases move ever closer to their respective court dates, the plaintiffs are optimistic that more individuals will join the MDL.
