IVC Filter Lawsuit Filings Rapidly Increase, As Allegations Of Device’s Potential Consequences Become More Public

The filters have been on the market since 1979 when the U.S. Food and Drug Administration (FDA) approved the medical devices. In 1979 only 2,000 patients received the devices. By 2007, 167,000 implantations had occurred.

IVC filters have become the focus of controversy due to hundreds of lawsuits that have been filed against the various manufacturers alleging that the devices are defectively designed and dangerous. A recent report by NBC News has also highlighted the issues surrounding the devices, as well as increased awareness of the potential dangers associated with using the filters.

The IVC filter is a small, cage-like device that is surgically implanted into a patients’ inferior vena cava veins who are at risk for the development of blood clots but cannot take traditional blood-thinning medications. When the device is implanted it catches blood clots emanating from the lower body and moving toward the heart and lungs. A pulmonary embolism could result if a clot reached the lungs. Other serious medical issues could arise as well. The use of the filter should be temporary, until the threat of blood clots has passed.

Many patients from all across the United States have filed lawsuits against a number of manufacturers of the filters. They allege that the devices have been left in their bodies and have fractured with the pieces migrating to other parts of the body. Plaintiffs claim the pieces can puncture veins or blood vessels, as well as become embedded in vital organs and intestines, thus causing other serious medical consequences. Some plaintiffs have stated that the pieces were unable to be removed since they had traveled to parts of the body where surgery could not be performed and deemed as too risky.
