New Jersey Man Files Xarelto Lawsuit Claiming Negligence And Exposure To Harm

July 03, 2016 – – TheProductLawyers.com offers insight on the case of a New Jersey man against Xarelto and its manufacturers—Janssen Pharmaceuticals and Bayer AG. Six months after beginning an anticoagulant regimen of Xarelto, he suffered a massive intestinal bleeding event, which required invasive measures to halt. He believes that the drug companies were negligent in their duty to apprise the public of the potential risks associated with Xarelto use and seeks damages and compensation for related and ongoing medical expenses.

Originally filed in the Eastern District of Louisiana in November of last year under case number 2:15-cv-06264, his case will join the more than 2,800 plaintiffs in multidistrict litigation (MDL) 2592. The U.S. Judicial Panel on Multidistrict Litigation (JPML) decreed in December of last year that all cases represented in the petition at the time would be combined to form the MDL. As well, any subsequent lawsuits brought before federal courts with similar claims would be incorporated.

The MDL and a mass tort program of 550 individuals slated to appear before the Philadelphia Court of Common Pleas represent more than 3,000 individual cases against the manufacturers of Xarelto. They commonly claim negligence on the part of the drug companies and seek reparations for their exposure to injury or death, both potential and real.

In 2011, the U.S. Food and Drug Administration approved Xarelto to treat patients healing after hip and knee replacement surgeries, as well as patients with pulmonary embolism or deep vein thrombosis. Shortly after this initial approval, the FDA expanded its approval to include treatment for patients with atrial fibrillation, who could be at increased risk for strokes.

As the plaintiffs in MDL 2592 look toward their respective court dates, they are optimistic that individuals will continue to come forward with similar claims.
