Child custody in any divorce case can be fraught with problems, but asking the right questions of their lawyer can better prepare a parent for the eventual outcome, asserts Daryl Weinman, founding partner of Weinman & Associates, P.C.

In an interview this week, Weinman urged parents caught in the midst of or about to be involved in establishing custody arrangements for a child to think about asking several questions of their lawyer, so they know what to expect.

“Understanding the law concerning your custody case will go a long way to reining in expectations and becoming more realistic to the potential outcomes,” cited Weinman, “Your lawyer should be advising you about how decisions will be made by the parents on behalf of the child, the geographic restrictions on the child’s residence, what the shared time with the child will look like, how child support will be calculated, how health insurance will be handled for the child, etc.”

Weinman urged parents to be better prepared for a court appearance, what it involves, and how a judge will balance arguments in deciding in the best interests of a child.

“Various factors and considerations will come into play, from the relationship they have had with their child leading up to the custody case, and the relationship they plan to have with the child going forward, the emotional needs of the child, and the overall environment in two homes in which the child can flourish,” Weinman said.

A parent should also be questioning their lawyer about the potential outcomes and how their rights will be affected in a child custody case.

“A lawyer needs to gather all the evidence to understand the client’s current circumstances, future plans, and involvement with their child to build a case around that. They need to understand that the court is going to start by looking at the status quo, so that they can ensure as much continuity and stability for the child as possible, and to maintain the child’s relationship with both parents.”

Weinman added that clients should not be afraid to question their lawyers on the financial support for a child, how that works, what is expected of them if they have to pay their ex-spouse, and the consequences of failing to meet that agreement.

“If a parent is fighting for custody, then they should be questioning their lawyer closely on all of the impacts of seeking child custody rights, their responsibilities, what their realistic expectations should be, and what that will look like in the long term.”

Weinman concluded: “Having a clear idea of what is expected and what is realistic going into a child custody case is very helpful. To get a firm idea on the expected route through court, a parent needs to be armed with the right knowledge. That
requires a lot of questions for their lawyer.”
