Learning mistakes from the rich and famous can help ordinary citizens avoid making eye-watering errors in their estate planning strategies, estate planning specialist Dennis Toman revealed this week.

The Founder of The Elderlaw Firm in Greensboro, NC., said one of the biggest mistakes made by celebrities – and anyone else – was dying intestate. “Dying without having made a plan could see a person’s assets carved up by a court and distributed to people they may never have considered a beneficiary,” he said.

If a person dies without making a plan, a court will determine their “heirs”. However, intestate proceedings could take years and drain the estate of unnecessary costs if there are challenges and lawsuits.

Mr Toman said: “Estate planning is the same for everyone. Taxes and legal fees can also eat into an estate if a plan is not watertight. And it can be further aggravated by missing or outdated documents, challenges by beneficiaries and circling debtors. More likely are disputes among family members, as seen with recent celebrity cases.”

Another mistake the wealthy make is failing to update and add or delete beneficiaries from their wills before they die. The key to any estate plan is to keep it regularly reviewed. He said: “An estate plan should reflect your changing life situation.”

He advised that working alongside and consulting an experienced estate planning attorney will help drive the direction of your assets and help you consider future benefactors. “This all ensures you have an effective plan that a trusted executor can handle if you die or become incapacitated.”

Two other mistakes made by celebrities were keeping their estate plans private and failing to write in things promised verbally. Ideally, an estate plan with all the original documents should not only be at hand, but it is advisable to tell someone you trust where the documents are located and what your plans are.

He emphasized: “If you have an experienced professional estate planning attorney, they will have a copy of your plans, usually in electronic form. But the owner should keep the original documents in a safe place. Make your executor aware of where they are, so they can be located when needed.”

If promises are made to loved ones, putting them down on paper and included in legally valid estate planning documents is essential. Doing this will avoid any confusion or potential legal battles.

One of the biggest failures of the famous is not having a trust to protect their assets from potential problems. Mr Toman said: “A trust can act as a way of privatizing and streamlining the process of transferring assets to benefactors. Assets will also have to be named in the trust to get the full protections and benefits of the trust.”

He concluded that anyone thinking of estate planning should seek guidance from an experienced estate planning attorney so they can be empowered to take action with the knowledge their assets and family are protected.
