Xarelto Lawsuit Says Manufacturers Fraudulently Misrepresented The Drug
December 01, 2015 – – BloodThinnerHelp.com reports on another lawsuit filed against Janssen Pharmaceuticals (a division on Johnson & Johnson) and Bayer AG which states that the pharmaceutical giants, as well as their researchers and developers have fraudulently misrepresented the benefits, dangers, and risks of blood-thinning drug Xarelto. This particular 32-count complaint was filed in the St. Clair County Circuit Court under number 15-L-581 on October 13th, 2015.
The complaint goes on to state that manufacturers neglected to adequately warn physicians about the dangers and risks that were connected with the new type of anticoagulant. Additionally, it alleged that they knowingly misrepresented the benefits presented by the drug, which the plaintiff believes that the dangers and risks far outweigh. The plaintiff is seeking damages in excess of $50,000 plus coverage for attorney fees and the cost of litigation.
Xarelto has been the topic of many recent lawsuits. Federally, the cases have now surpassed 1,700, and have been consolidated to form multidistrict litigation number 2592. This consolidation was done by the Judicial Panel on Multidistrict Litigation, and should help legal proceedings to run more smoothly and efficiently. Additionally, it will help avoid duplicate discovery or different rulings from multiple judges, and save time and money for everyone involved.
The cases which have been consolidated all share similar allegations that use of the blood thinner can cause dangerous uncontrollable bleeding. Xarelto was released to the market as a new, revolutionary blood thinner, but, as many of the current plaintiffs point out, the drug was released without a corresponding antidote. This means that patients who have Xarelto in their system and begin to bleed are in significant danger. Physicians have no antidote to counter the effects of the medicine and get their blood to clot. In these cases, doctors must resort to life-saving blood transfusions in an attempt to keep the patient from losing too much blood.
Patients taking traditional blood thinners do not have the same issue. When these patients begin to bleed, physicians can treat them with vitamin K, which counters the effects of the medication and allows their blood to clot, potentially saving the life of a the patient.
As the cases involved in the current Xarelto MDL await trial and over 500 others have come together in a mass tort group in Philadelphia.
