Power Morcellator Lawsuit Alleges PKS PlasmaSORD Device Spread Uterine Cancer Cells

December 15, 2015 – – Tracey & Fox reports on another lawsuit filed against a laparoscopic power morcellator manufacturer. In this particular case, the complaint was filed against Gyrus Acmi LP, a subsidiary of Olympus Corporation and manufacturer of the PKS PlasmaSORD Bipolar Morcellator. Allegations found within the suit claim that the tool spread previously undetected cancer cells throughout the plaintiff’s abdomen during a gynecological surgery on uterine fibroids.

During this surgery, the power morcellator was inserted into the plaintiff’s abdomen through a small incision. Once inside, the power morcellator worked much like a drill by rapidly spinning tiny blades designed to tear apart the woman’s painful uterine fibroids. According to the plaintiff’s allegations, however, as the tool did this, it also shred tissue containing cancer cells that she was unaware of, exposed those cells, and spread them throughout her body. This not only helps to accelerate the cancer, it also makes it harder to treat. This can have a significantly negative impact on the life expectancy of the patient.

As similar allegations against various brands of power morcellators began to appear across the United States, the U.S. Food and Drug Administration issued their own safety warning regarding the device. They indicated that most women should refrain from undergoing laparoscopic power morcellation on uterine fibroids due to the risk of spreading undetected cancer cells. They indicated that an estimated 1 in every 350 women who undergo these types of gynecological surgeries have uterine sarcomas that they are unaware of which the surgery could accelerate and spread.

This particular lawsuit, as many others do, included a plaintiff who believed she was removing benign tumors from her uterine cavity. The plaintiff’s complaint stated: “The PKS PlasmaSORD Bipolar Morcellator disseminated and seeded cancer throughout the plaintiff’s abdominal cavity, thereby causing and accelerating the metastases and spread of her cancer, worsening the long-term prognosis and natural course of her cancer.” And also: “The spread of the life-threatening cancer suffered by the plaintiff was a direct result of the use of the PKS PlasmaSORD Bipolar Morcellator during her 2011 surgical procedure.”

Across the U.S., cases filed against power morcellator manufacturers continue to rise. These cases all similarly allege that the device is spreading cancer when used during gynecological surgeries on uterine fibroids. The cases have been consolidated to form multidistrict litigation number 2652 and are being overseen by the Honorable Judge Kathryn H. Vratil in the U.S. District of Kansas.
