Xarelto Lawsuit Parties Disagree On Method Of Bellwether Trial Selection For MDL 2592
January 04, 2016 – – BloodThinnerHelp.com reports on discussions surrounding the bellwether trial selection process for Xarelto lawsuits consolidated in multidistrict litigation nuber 2592 in the Eastern District of Louisiana. These lawsuits were consolidated by the U.S. Judicial Panel on Multidistrict Litigation approximately one year ago. Since this time, both defendants and plaintiffs have been involved in pre-trial preparations which includes selection of bellwether cases to be heard at trial.
The selection of bellwether cases, which is set to take place shortly, has become a point of contention. Overseeing Judge Eldon Fallon has directed those involved to propose a plan for selecting a pool of 40 initial bellwether cases to be prepped for early trials. He has asked that each party select 10 cases, leaving the other 20 cases to be chosen randomly.
It has been reported that at this time, each party has in fact submitted motions which outline how they believe the bellwether selection process should proceed, but each of the sides appear to wish for something different, which means that the court will now be required to decide how things should proceed.
One thing that involved parties appear to disagree on is whether or not location should play a role in determining which cases are selected. A recent order by Judge Fallon indicates that the first two trials should take place in Louisiana, where the MDL is housed. He has asked, however, that the other two take place in Mississippi and Texas.
An announcement from September 17th of 2015 specified that the 40 cases chosen for the bellwether discovery pool should include 20 from the Eastern District of Louisiana, 6 from Mississippi, 2 from Texas, and 12 from various other states. While defendants support this order, plaintiffs have requested reconsideration due to geographical restrictions which might “seriously impair the ability to identify representative cases.” They indicated that this option would reduce cases which are eligible to be included in the bellwether pool by 85%.
According to recent plaintiff statements, cases involved in the MDL now number over 2,800. Of these cases, a total of 331 were originally filed in the Eastern District of Louisiana, the state of Texas, and the state of Mississippi. Plaintiffs argue that excluding all other cases (which make up over 80% of the MDL, would risk the process of the entire bellwether plan. At this time, they have instead proposed that cases be divided into categories based on the type of injury reported by the plaintiffs.
Involved parties will now await further decisions and instructions as things progress.
