As Invokana Lawsuit Plaintiffs Begin To File Suit, Side Effects Surrounding The Drug Cause Public Concern
March 09, 2016 – – TheProductLawyers.com reports on the latest news surrounding new-generation, type-2 diabetes drug Invokana. Since its 2013 FDA approval, the drug has now become the subject of several lawsuits linking it to various health problems, including cardiovascular damage and kidney failure in patients.
Invokana works to maintain blood sugar (glucose) levels in type-2 diabetes patients, and it does this by preventing the kidneys from absorbing any extra sugar and instead forcing them to remove the sugar from the body via urination. This process understandably depends heavily on the kidneys, and, therefore, puts substantial stress on them. As kidney problems can be common in diabetic patients even without the medication, those with pre-existing kidney problems should be especially aware of this potential danger.
On December 15 of 2015 in a Southern Alabama District Court, a plaintiff filed a lawsuit against Invokana manufacturer Janssen Pharmaceuticals (a division of pharmaceutical giant Johnson & Johnson). The lawsuit details state that the plaintiff had used the drug without being previously made aware of the serious and dangerous side effects possible. She indicates that she used the drug for only a short time when she suddenly developed diabetic ketoacidosis, a potentially life-threatening condition in which the body’s bloodstream contains too much toxic acid.
The plaintiff believes that the defendant showed negligence by not making the public and medical professionals better aware of these serious risks, and by neglecting to adequately study and vet the drug before releasing it to market after approval by the U.S. Food and Drug Administration in 2013. In addition, she notes that she was taking the drug to treat her type-1 diabetes, as it had been promoted “off-label” for this use. “Off-label” means that this use was never FDA-approved, but was advertised by the manufacturer: a very controversial marketing move.
In 2013, Invokana was the first of several similar new-generations drugs which were released for diabetes patients; all members of the SGLT2 inhibitor class. Although adverse event reports to the FDA have now been made surrounding all of these drugs, Invokana is the drug most commonly discussed by patients.
