In the first quarter of 2012 there were 130,000 prescriptions for Xarelto issued in the United States. EvaluatePharma has estimated in its World Preview that if these sales continue at this rate, Xarelto will become the 19th best selling drug in the world and by 2018 will generate 3.7 billion U.S. dollars in sales, a huge increase from the $596 million in sales the drug generated in 2012. These sales can be attributed to Xarelto’s intense marketing and also because of the cost of Xarelto in general. A one year’s supply of Xarelto costs $3,000, a steep cost compared to a one year supply of Warfarin, which only costs $200.

A growing number of lawsuits have been filed across the country alleging that Xarelto caused internal bleeding injuries and death. These lawsuits also allege that Xarelto’s manufacturers concealed information from doctors and patients about the real dangers of Xarelto, especially concerning the fact that Xarelto does not have a reversal antidote. The lawsuits that have recently been filed also highlight the market share that Xarelto has captured because of the promotional techniques used.

Trials in the Xarelto lawsuits have not begun, so there has not been a Xarelto lawsuit settlement yet. The cases in the MDL and the Philadelphia Mass Tort Group are being filed individually, so it is very difficult to estimate how much any case will settle for because the circumstances of these lawsuits vary greatly from case to case.

Each lawsuit filed will list a variety of economic and non-economic damages that the plaintiffs allege Xarelto was the cause of. Examples of economic damages include treatment costs, medical expenses, long term or future care, funeral or burial expenses, and loss of wages or future income due. Non-economic damages are things such as the pain and suffering for the injuries caused, or the pain and suffering caused by losing a loved one.

While we are unable to estimate how much any Xarelto lawsuit settled for, we can look to past litigation for a general idea. Recently, lawsuits were filed against a blood thinner similar to Xarelto, Pradaxa. These lawsuits settled in May 2014 and the drug’s manufacturer, Boehringer Ingelheim, settled 4,000 lawsuits against Pradaxa for $650 million.

Xarelto Lawsuits Filed in MDL and Mass Tort Group:

As of May 2015, more than 400 federal lawsuits filed against Xarelto have been transferred to the multidistrict litigation, MDL, set up in the Eastern Judicial District of Louisiana . There are also more than 100 lawsuits filed in a mass tort group in Philadelphia, PA. Both of these legal systems are set up specifically to handle claims from individuals and families who all make similar allegations regarding Xarelto against Bayer AG and Johnson&Johnson.
