Gainsberg Law Files Suit against Chicago Transit Authority
Gainsberg Law has filed a lawsuit on behalf of a client who lost a leg after being run over by a CTA bus.

Gainsberg Law P.C. has filed a lawsuit on behalf of Efrain Sanchez, who was denied service by a Chicago Transit Authority bus driver named Betty Day. After Ms. Day refused Mr. Sanchez service, the lawsuit alleges, she ran over Mr. Sanchez, leading to his significant injuries and the partial amputation of his right leg.
“This is an egregious act of negligence, and our client has already lost part of his leg as a result,” said Neal Gainsberg, firm founder. “Ms. Day’s actions have led to a long-term hospital stay for our client, as well as thousands of dollars in medical bills. I don’t know what possessed her to keep driving without any regard for his safety, but both the CTA and Ms. Day must be held accountable for this flagrant failure to obey the law, and to protect the safety of Chicago riders.”
The lawsuit has been filed in the Circuit Court of Cook County. At this time, the bus driver has not been cited in any way.
The lawsuit against CTA and Betty Day
On September 1, 2018, Mr. Efrain Sanchez attempted to board a Chicago Transit Authority (CTA) bus going northbound on Pulaski Avenue, at approximately 2:20am. The bus driver, Ms. Betty Day, opened the doors of the bus, and Mr. Sanchez walked towards it. When he was next to the bus, Ms. Day closed the doors. Mr. Sanchez knocked on the door of the bus with his hands; however, instead of opening the door, Ms. Day started to pull away.
Because of his close proximity to the side of the bus when it pulled away, Mr. Sanchez was unable to maintain a safe distance from the bus. He fell in the street. Ms. Day then drove over Mr. Sanchez’s body and right leg, and continued to drive until she was pulled over by police several blocks away. A video recording of the incident shows that Ms. Day was fully aware of Mr. Sanchez’s presence, yet she left the scene anyway.
Mr. Sanchez has been hospitalized since the accident at John H. Stroger, Jr. Hospital of Cook County. He suffered multiple fractures to his right leg, and has undergone almost 10 surgeries. The lower half of his right leg has already been amputated after an infection set in during his treatment. His doctors are trying to save the rest of his leg.
The lawsuit alleges that Ms. Day, as an employee of the Chicago Transit Authority, was directly accountable for the injuries our client sustained. The lawsuit asks for compensation for all current and future medical expenses, pain and suffering, lost wages, permanent and disfiguring disability, and mental anguish.
