Johnson & Johnson Loses Third Trial Among Slew of Talcum Powder Lawsuit Filings

November 07, 2016 – – TheProductLawyers.com reports on a recent loss suffered by Johnson & Johnson in the third trial concerning their talcum powder products.

According to Bloomberg, Johnson & Johnson recently lost a third trial over claims its talcum powder can cause ovarian cancer. The St. Louis jury awarded a California woman more than $70 million. The suit was among 1,700 that have been filed in state and federal court against the pharmaceutical giant. Johnson & Johnson was ordered to pay $65 million in punitive damages and 90 percent of about $2.5 million for medical costs and pain and suffering, the news source said. Co-defendant Imerys Talc America, the supplier of the talc, was forced to pay $2.5 million in punitive damages.

Cases such as these have been filed all across the U.S. and other similar cases are being filed in Canada. All of these cases allege that Johnson & Johnson was negligent in their marketing and sale of talcum powder products by not warning consumers about the alleged danger of developing ovarian cancer when using the powders as a feminine hygiene product.

Numerous studies have found that women who use baby powder as a feminine hygiene product are more likely to develop ovarian cancer. Johnson & Johnson has maintained denial in these claims and has previously stated that there is no link between talcum powder and ovarian cancer. The company has never released a warning about the potential risks of its Johnson’s Baby Powder and Shower-To-Shower products.

Several plaintiffs, such as the one in the most recent trial, have already been awarded millions of dollars in compensation and lawsuit numbers are continuing to grow. Most of the filed cases are pending in a Missouri federal court, while others have been filed in New Jersey, where Johnson & Johnson is headquartered.
