Jury Returns Verdict in Excess of $1 Million to Medical Malpractice Client of Bailey & Greer

Bailey & Greer obtained a jury verdict in excess of $1 million on behalf of their medical malpractice client, who sustained life-altering injuries after being treated by Dr. Mason Mandy of Nubody Concepts in Brentwood, TN.

R. Sadler Bailey and Thomas Greer obtained a jury verdict in excess of one million dollars on behalf of their client in a case against Dr. Mason W. Mandy of Nubody Concepts in Brentwood, TN. The total compensatory damages amounted to $1,062.432.23.

The Rutherford County jury also found Dr. Mandy liable for punitive damages, but before the jury heard additional proof to determine the amount of punitive damages, Dr. Mandy settled for an amount substantially greater than the jury verdict. The case against Nubody Concepts was resolved prior to trial through a confidential settlement.

An egregious lack of care for a patient, and a cover-up of wrongdoing

In 2014, the plaintiff saw a TV commercial from Nubody Concepts advertising a non-invasive procedure called aqua liposuction. On his first visit to Nubody, he paid for the procedure and scheduled it for a week later. When the plaintiff returned, Dr. Mandy informed him that he needed an abdominoplasty, commonly known as a “tummy-tuck,” instead of liposuction. Dr. Mandy correctly advised the patient he would need a driver following the surgery.

Upon learning that he needed a driver, the plaintiff sought to cancel the surgery and requested a refund. At this point, Dr. Mandy changed his tune. Seeking to avoid financial loss, Dr. Mandy told the client he would perform the surgery and that it would be safe for him to drive home after.

According to experts in the field of both plastic and general surgery, this was a gross violation of the standard of care. Nevertheless, the surgery was performed and two hours later Dr. Mandy discharged the plaintiff to make the 90 mile drive home. He never made it.

Quite foreseeably, the plaintiff experienced a sudden and severe bought of pain at the incision site, which caused an immediate drop in blood pressure and a loss of consciousness. He accelerated off the road and straight into a ditch. The plaintiff was airlifted to Vanderbilt and treated for a broken neck and other serious injuries to his ribs, pelvis, and shoulder. He wore a cervical halo for several months but ultimately made an amazing recovery, considering the severity of his injuries.

During the trial two eyewitnesses, a nurse and the office manager at Nubody, testified that Dr. Mandy admitted to releasing the plaintiff shortly after discharge. Dr. Mandy denied this at trial and attempted to blame the plaintiff for leaving against medical advice. There was strong evidence presented at trial that Dr. Mandy falsified medical records and destroyed others, in an attempt to cover-up his misconduct. An email sent by Dr. Mandy contradicted his medical records and confirmed that he indeed released the patient to drive home. The email had fortunately been copied by the nurse before it disappeared, and was discovered by Bailey & Greer during the course of the litigation. The jury found in favor of the plaintiff, rejecting Dr. Mandy’s unfounded allegations.
