When a couple with children goes through a divorce, the court will enter a Parenting Plan Order that determines how many days per year each parent will have with the children and the specific schedule to be followed during the school year, vacation periods and on holidays.

In Tennessee, when a court establishes a Parenting Plan, one of many factors it is permitted to consider includes the reasonable preference of a child 12 years of age or over.  If such a child wants to spend more time with one parent than another, things can get complicated.

Even worse, there are situations when, after the divorce and the Parenting Plan is in place, a child starts refusing to spend time with one of the parents. If the child is relatively young, a court will likely require that child to visit with the parent involved per the schedule in the plan.  “However,” says King, “once a child reaches the middle adolescent years, and gets closer to emancipation, many judges will be reluctant to try to force him or her to spend time with a parent against his or her will.”

According to King, when a child expresses a desire to spend less time or no time with one parent, an attempt should be made, by both parents, to find out the reason for that desire and to turn the child’s attitude around.  Consulting with a therapist can be a good step in that direction.  Such cooperation between parents makes it less likely that they will have to go back to court over new claims, such as that one parent is trying to alienate the child from the other.

King suggests: “Every situation is different. Parents would do well to seek advice from a family law attorney, with experience in such matters, about where they stand legally when a child refuses to cooperate with the parenting schedule.”
