Montana Parents Among The First To File Zofran Lawsuit

December 02, 2015 – – ZofranLegal.com has reported that the parents of a young girl in Billings, Montana were among the first to file a lawsuit against GlaxoSmithKline, the manufacturer of the anti-nausea drug Zofran. Their complaint was filed in the U.S. District Court District of Montana Billings Division under claim number 1:15-cv-00026-SPW-CSO on April 3rd, 2015.

Their daughter was born in 1998. At the time of her birth she was diagnosed with a cleft lip and a cleft palate. Her parents have noted that there is no family history of her condition. She has undergone ten separate surgeries since her diagnosis, and her doctors have indicated that she will likely need additional procedures in the future.

Her parents allege that the drug Zofran caused the cleft lip and cleft palate. Her mother was prescribed the drug as a treatment for her morning sickness during the first trimester of her pregnancy. She claims that “GSK knew that Zofran was unsafe for ingestion by expectant mothers.”

GSK was notified in 1991 that Zofran had received U.S. Food and Drug Administration approval. However, the approval only indicated that the drug could be safely prescribed to patients who were experiencing nausea and vomiting after anesthesia, chemotherapy, and radiation.

The company began a marketing campaign that lead the medical community and the public to believe that Zofran was safe for both expectant mothers and their unborn children. Doctors throughout the country prescribed the drug to their patients. Not long after GSK launched their campaign, physicians allegedly began to submit reports indicating that their patients had given birth to children with birth defects after the mother was prescribed Zofran.

The U.S. Department of Justice pursued a lawsuit against GSK that alleged that the company had unlawfully promoted several drugs, including Zofran, off-label. While the company never admitted to any wrongdoing, they did agree to a settlement in 2012. This settlement agreement included a fine of $3 billion dollars.

GSK now faces numerous complaints, each one alleging that their drug caused a birth defect such as atrial septal defect, ventricular septal defect, transposition of the greater vessels, clubfoot, kidney defects, cleft lip, and cleft palate.
