Nadrich & Cohen Supports Restoration of EPA Pesticide Ban

The federal appeals court recently overturned the EPA’s ban on chlorpyrifos, a dangerous compound with known adverse health effects.

This November, a federal appeals court overruled the EPA’s 2021 ban on chlorpyrifos – a pesticide linked to brain damage in children. Personal Injury law firm Nadrich & Cohen, LLP opposes this ruling and supports the EPA reinstating the ban.

In 2021, the Ninth Circuit Court of Appeals gave the EPA a 60-day deadline to ban chlorpyrifos from food production unless it could find a safe use for the pesticide. In response, the EPA issued a ban on the chemical.

The Eighth Circuit Court of Appeals overruled this ban in November, claiming that the deadline rushed the EPA’s decision before it could fully consider possible safe uses for chlorpyrifos.

However, research from PNAS indicates that exposure to chlorpyrifos in pregnancy can lead to babies and is associated with attention deficit disorders, reduced IQ, lower birth weights, and more.

“The overturning of the ban is a tragedy for families and workers injured by chlorpyrifos,” Nadrich says. “It means that thousands of people could have their health put at risk. According to the CDC, exposure to the compound could cause blurred vision, eye-watering, excessive salivation, dizziness, confusion, headaches, muscle weakness, tremors, diarrhea, and sudden heart rate changes. Therefore, it is clear that this is not a chemical that should be coming into contact with consumers.”

Both Nadrich and fellow law firm attorney Randal Cohen support reinstating the EPA’s ban on chlorpyrifos to protect their clients. The duo believes in full restitution and compensation for any harm done by the chemical. 

“We’re calling on the courts and the EPA to reinstate the ban on this harmful chemical,” Cohen says. “The Ninth Circuit already gave the EPA a 60-day deadline to ban chlorpyrifos from food production unless it could find a safe use for the pesticide. The fact that it failed the latter demonstrates the hazardous nature of this substance.”
