Ohio Couple’s Xarelto Lawsuit To Join MDL

July 01, 2016 – – TheProductLawyers.com reports on the latest individual lawsuit to join the multidistrict litigation (MDL) 2592 against the manufacturers of Xarelto. Filed by an Ohio couple, the suit alleges after the woman began taking Xarelto, it contributed to an unmitigated intestinal bleed, anemia, and other debilitating medical complications. The couple seeks more than $150,000 in damages from the manufacturers, Janssen Pharmaceuticals, and Bayer AG, to defray the cost of ongoing medical care.

The FDA issued approval for Xarelto in 2011. It was hailed as a breakthrough anticoagulant in medical circles and by the public and was approved to function as a treatment for deep vein thrombosis, pulmonary embolism, or as a clot preventative in those recuperating from hip or knee replacement surgeries. Soon after its approval, it was also applied as a preventative measure for individuals with atrial fibrillation, a heart disorder that elevates the risk for stroke.

In the years since its debut, the drug has received two black box warnings from the FDA, a strict measure that can immediately precede the recall of the product from the market. Common allegations against the drug are that it places those taking it at an increased risk of catastrophic bleeding events, and can result in injury and even death. Late last year, the U.S. Judicial Panel on Multidistrict Litigation (JPML) responded to petitions for lawsuit combination and agglomerated more than 2,800 cases with similar claims to form MDL 2592.

The JPML also stipulated that subsequent individual lawsuits with similar claims would be added to the MDL. In the case of the Ohio couple, the woman began taking Xarelto on the advice of her family physician as a stroke preventative. Only two months later, she was diagnosed with an uncontrolled intestinal bleed, which required invasive mitigation and continues to require care.

As the plaintiffs of MDL 2592 look toward their respective court dates, they’re confident that additional cases such as that of the Ohio husband and wife will continue to join the MDL.
