Power Morcellator Lawsuit Alleges Device Spread Uterine Cancer And Caused Womanâs Death
December 17, 2015 – – Tracey & Fox reports on another lawsuit filed against Ethicon, a subsidiary of Johnson & Johnson, alleging that the power morcellator device they manufacture caused the spreading of uterine cancer and ultimate death of a Missouri woman. The lawsuit was filed by the family of the deceased woman. They indicate that the woman underwent a hysterectomy to remove uterine fibroids with the Ethicon Power Morcellator device, and was diagnosed with fatal cancer shortly after that gynecological surgery.
Ethicon is just one of multiple companies who manufacture various versions of the power morcellator device. It works much like a drill, entering the abdomen through a small incision, and rapidly spinning blades once inside to shred and rip apart uterine fibroid tissue. In doing so, however, some allege that the tool can uncover hidden cancer cells, and its motion can disseminate those cells outside of the uterine cavity and throughout the body.
Many plaintiffs have now filed similar lawsuits against various power morcellator devices, stating that this spreading of cancer cells causes an accelerated cancer which is difficult to treat and often deadly. Many allege that, had the cancer not been spread by a power morcellator device, it would have remained contained and may have been more easily treated.
The U.S. Food and Drug Administration has also issued a statement regarding power morcellators, indicating that women should refrain from undergoing laparoscopic power morcellation on uterine fibroids due to the risk of spreading and accelerating cancer cells. They indicated that an estimated 1 in every 350 women currently undergoing these procedures has undetected uterine sarcoma cells which could be disseminated with the tool.
Shortly after this FDA announcement, which took place in 2014, Ethicon ceased all power morcellator production, and recalled their brand of power morcellators currently being used. Unfortunately, many other companies still manufacture and market the tool.
Lawsuits claiming that Ethicon’s power morcellators spread uterine cancer have now been consolidated to form multidistrict litigation number 2652 in the U.S. District of Kansas. These cases are being overseen by the Honorable Judge Kathryn H. Vratil.
