Texas Man Survives After Semi-Truck Rolls Over Onto Vehicle

A San Antonio man survived a serious accident that resulted in a semi-truck rolling over onto his vehicle. Texas based personal injury attorneys report that the 61-year-old man was waiting for the light to change when another vehicle swerved in front of a cargo truck, causing it to swerve and rollover.

“A Texas man survived a traffic accident after a semitrailer rolled over and landed on his Toyota Tundra on July 21…David Herndon, 61, of San Antonio, Texas, had stopped at a light, My San Antonio reported. As he was waiting for the light to change, a Chevrolet Tahoe swerved in front of a Lowe’s Home Improvement cargo truck. The semitrailer then swerved and rolled on its side.”

The impact of the collision caused the truck trailer to land on top of the man’s truck, and push it backwards into others cars. He was able to pull himself out of the vehicle.

The Deadly Reality of Rollover Accidents

Although the man in the aforementioned truck rollover crash was able to walk away unscathed, this is not the case for many victims of these types of crashes. Texas based truck accident attorney Amy Witherite says that a number of personal injury cases involving rollover accidents she has tried involve fatalities. According to Witherite “statistics show that rollovers claim thousands of lives each year nationwide.”

Data from the National Highway Traffic Safety Administration shows that over 280,000 rollover accidents are reported annually. The NHTSA stated in a report on the “Characteristics of Fatal Rollover Crashes” published by the National Center for Statistics and Analysis Research and Development that “The changing composition in the fleet of vehicles on the nation’s highways has resulted in a growing number of SUVs and other light trucks relative to passenger cars. Findings show that light trucks in general, and Sport Utility Vehicles (SUV) in particular, are a rapidly increasing component of the total number of fatal rollover crashes. Most of the characteristics of vehicle and drivers involved have remained fairly constant over time both for passenger cars and light trucks. While occupant fatalities due to passenger car rollovers have been declining, the greater propensity toward rollovers in some classes of light trucks has maintained the aggregate level of passenger vehicle occupant fatalities in crashes about 32,000 annually.”

Among the most common causes of rollover crashes are:

Drivers over correcting their vehicles
Drivers operating vehicles that are top heavy
Drivers hitting medians, guardrails, uneven ground and other factors that may cause their vehicle to suddenly go out of control and flip over
Vehicles being too top heavy (whether by design or added weight)
Driving aggressively (speeding, recklessly changing lanes, or driving erratically in any form)

Witherite says that in truck accident cases involving rollovers one of the most important things injured victims, or families of deceased victims in the event of wrongful death, can do is get an assessment of their legal options for financial recovery. The attorney says that in many cases of rollover accidents in Texas, those most seriously injured or left with significant property damage are individuals not at fault for the crash. Investigators were still looking into the recent Texas truck rollover accident at the time of the report.
