Sweeping justice reforms now make it far easier for Ohio residents to hide their criminal records or even wipe them and start with a clean slate, leading criminal attorney Edward La Rue revealed this week.

His comments came as his law firm in Cleveland has fielded an increasing number of inquiries from the public about expunging or “sealing” their previous criminal records in the wake of new laws passed by the state.

In April, Ohio lawmakers agreed to new legislation regarding the sealing and expunging of criminal records, conviction records, bail forfeitures, findings of not guilty, dismissed charges, and a “No Bill” issued by a grand jury.

For the first time, the law stipulates a difference between “sealing” and “expunging” a record, said La Rue.

A “sealed” record is one that is removed from all public records, with the public no longer able to access a criminal record. This can apply to potential landlords or employers seeking background checks. However, the sealed record remains in government archives for access for limited purposes.

An “expungement,” is a complete deletion or erasure of a record, ensuring the record is permanently irretrievable.

La Rue said the law changes had widened the eligibility for expungement. In the past, there was a limit on how many criminal offenses a person could apply to get expunged, but the new law eliminates of some of those limitations.

The law now allows for an unlimited number of eligible misdemeanors and low-level felonies (F4, F5s) to be deleted.

La Rue said the law lists a number of criminal records that will not be eligible for sealing or expungement. These include first and second degree felonies, traffic offenses, sex or violent crimes, and those with more than two third-degree felonies. Additionally, crimes against victims aged under 13 and violation of protection orders and convictions for domestic violence also apply.

He emphasized that eligibility does not mean an automatic right to expungement. That still lies with a judge on application, and they can still reject expungement applications for various reasons.

La Rue concluded: “The potential to expunge or seal a record is within reach for many people. Given the number of inquiries through my office, many see this as a viable option to apply.‘’
