Cleveland, Ohio, United States – September 2, 2023 —
Many people are unaware of the many differences between sex crime charges and the effect they could have on their lives in the long run, leading criminal defense attorney Edward R.La Rue said this week.
La Rue, the founding partner of the Law Offices of Edward R La Rue in Cleveland, OH, said sex crimes could technically differ on many levels in the eyes of the law and carry varying sentencing lengths.
A sex crime allegation can vary from someone being charged with rape, sexual battery, gross sexual imposition, importuning, unlawful sexual activity with a minor, sex trafficking and more.
“Many assume all sex crime accusations are the same, but they are not. There are several terms associated with these charges, so it’s important to know what they mean,” he said.
He said: “Forcible rape differs from those accusations where the accuser cannot consent by law, such as a young child, sleeping partner, or an intoxicated individual, as it requires that force or a violent threat of force preceded the sexual encounter.”
What was once known as “Statutory Rape”, known under Ohio law as “Unlawful Sexual Conduct with a Minor”, is defined as sexual conduct involving penetration between an older individual and anyone between 13 and 16 years of age. It can have a variety of different sentencing outcomes depending on the circumstances.
La Rue added: “Certain details of an Unlawful Sexual Conduct with a Minor case, such as the age of the victim and the Accused, or the difference in age between the two, can drastically lead to varying legal repercussions. However, even if the underage party consented to intercourse, it’s still considered an Unlawful Sexual Conduct with a Minor offense.”
A Rape conviction is considered a first-degree felony in Ohio, the most serious provided for by law.
Rape convictions can carry severe punishments, from three to ten years if the victim is an adult, and up to life imprisonment without parole if the victim is a minor that was under 13 years of age at the time of the offense. Offenders can also face additional fines of up to $20,000, and mandatory registration as a sex offender for decades.
He concluded that seeking legal advice from an experienced defense attorney specializing in this field should be a priority if a person is ever faced with a sex crime charge.
