Xarelto Lawsuit Plaintiffs Involved In MDL No. 2592 Look Ahead To Bellwether Trial Dates For Early 2017
February 11, 2016 – – BloodThinnerHelp.com reports on bellwether trial dates which have been set for Xarelto-related lawsuits consolidated in multidistrict litigation no. 2592. The MDL cases are being overseen by Judge Eldon Fallon in the Eastern District of Louisiana and underwent bellwether trial preparations in early January of 2016.
According to court documents regarding the MDL, the initial two bellwether trials are set to be heard on February 6 and March 13 of 2017. The final two of four will then take place on April 24 and May 30 of 2017. Xarelto MDL lawsuits have continued to rise in number and now involve over 2,800 cases with plaintiffs who share strikingly similar allegations that Xarelto puts those taking it at increased risk of uncontrollable bleeding episodes.
The blood thinning drug has been linked to gastrointestinal bleeding, strokes, blood clots, stomach bleeds, eye bleeds, and brain hemorrhages by those who have used it, and by recent medical research. Plaintiffs claim that Xarelto manufacturers Bayer AG and Janssen Pharmaceuticals failed to sufficiently warn consumers about these risks. They commonly agree that advertising for the drug is misleading in that it does not mention many of these concerns.
According to the overseeing judge’s requests, at this time, the court, the plaintiffs, and the defendants should have chosen 40 cases to make up a bellwether pool and have also likely chosen four of those 40 cases to continue to bellwether trials in 2017. The upcoming bellwether trials are designed to provide everyone involved with a better idea of how juries are likely to respond to certain testimony and evidence in future trials.
