The First Lawsuit Alleging Zofran Caused Cleft Palate

On April 3, 2015, parents from Billings, Montana became America’s first family to file a lawsuit claiming that GlaxoSmithKline’s anti-nausea drug Zofran caused their child’s cleft palate. In 2012, researchers from Harvard University found that women prescribed Zofran’s active ingredient were twice as likely to deliver babies with cleft palate. Led by Monheit Law, a multistate alliance of attorneys has joined forces to investigate similar claims against Zofran’s manufacturer.

During the first four months of 2015, at least five families have brought legal claims against GlaxoSmithKline. The most recent, filed by parents from Billings, Yellowstone County, Montana, alleges that the company’s anti-nausea drug Zofran caused their child’s major birth defects: cleft lip and palate. In 2012, a team of researchers from Harvard University found that women exposed to Zofran’s active ingredient, ondansetron, were more than twice as likely to deliver babies with cleft palate.

Plaintiffs allege that their child, now sixteen years old, “has had to undergo ten surgeries to try and correct her cleft lip and palate. [The] birth defect impairs her development and enjoyment of a normal life at home and at school.” The family’s complaint was filed in the United States District Court of Montana, under docket number 1:15-cv-00026-SPW-CSO.

Plaintiff claims that she was prescribed Zofran as an “off label” treatment for the nausea and vomiting of pregnancy commonly known as “morning sickness.” Zofran is approved by the US Food & Drug Administration for the treatment of severe nausea and vomiting in patients undergoing chemotherapy, radiotherapy and surgical anesthesia. The drug’s manufacturer, GlaxoSmithKline, has never sought its approval as a treatment for morning sickness, and has never conducted clinical trials to determine Zofran’s effects in pregnancy or those it may cause in developing babies.

Despite those facts, plaintiffs in 1:15-cv-00026-SPW-CSO allege that GlaxoSmithKline “marketed Zofran ‘off label’ as a safe and effective treatment” for morning sickness. Under US law, pharmaceutical manufacturers are only allowed to market their products for approved uses. Plaintiffs claim that GlaxoSmithKline promoted Zofran as “safe and effective” during pregnancy, “despite having knowledge that such representations were utterly false, as GSK had never once undertaken a single study on the effects of this powerful drug on a pregnant mother or her growing child in utero.”

These allegations are similar to charges filed in 2012 by the US Department of Justice (DOJ). In a landmark case, the federal government claimed that GlaxoSmithKline had “promoted certain forms of Zofran, approved only for post-operative nausea, for the treatment of morning sickness in pregnant women.” The DOJ claimed that the pharmaceutical company had “paid kickbacks to health care professionals to induce them to promote and prescribe” multiple drugs, including Zofran. While GlaxoSmithKline continues to deny these allegations, the company eventually entered a settlement agreement totaling $3 billion to resolve its criminal and civil liabilities.

But the plaintiffs in Montana’s first Zofran birth defect lawsuit go further. They allege that GlaxoSmithKline “knew that Zofran was unsafe for ingestion by expectant mothers” as early as the late 1980s.

Citing a series of studies allegedly conducted in the 1980s, plaintiffs claim that tests on pregnant animals showed that “Zofran’s active ingredient transfer[s] through the placental barrier […] and expose[s] fetuses to substantial concentrations.” Further, the complaint alleges that GlaxoSmithKline’s animal studies “revealed evidence of [Zofran’s] toxicity, [including] intrauterine deaths and malformations in offspring.” Plaintiffs claim that GlaxoSmithKline failed to disclose these study results to the FDA.

Plaintiffs allege that, by 2000, GlaxoSmithKline had received at least 32 birth defect reports “associated with the use of Zofran by pregnant women.” The complaint states that “in many instances, GSK received multiple reports in the same month, the same week and even the same day. For example, on or about September 13, 2000, GSK received three separate reports involving Zofran use and adverse events. For two of these incidents, the impact on the baby was so severe that the baby died.”

Plaintiffs claim that GlaxoSmithKline was required to revise Zofran’s warning label and include “a warning as soon as there is reasonable evidence of an association of a serious hazard with a drug,” further noting that, under federal law, the finding of a causal relationship is not necessary. The complaint refers to the “hundreds of reports of birth defects” associated with off-label Zofran use, and claims that these reports would be sufficient to establish an association between Zofran and major birth defects. Plaintiffs allege that GlaxoSmithKline failed in its obligation to alter Zofran’s warning label and failed “to disclose these severe adverse events to healthcare providers or expectant mothers.”

London’s commercial property market continues to be dominated by optimistic rental growth prospects and growing yields, according to a report on Commercial Property published by London Office Space yesterday.

“Activity levels across all commercial sub-sectors began to accelerate in February, which is consistent with the trends observed during the past six months,” said London Office Space spokesperson Katherine Aird. “London’s established reputation as a global hub for businesses in the knowledge economy has brought about an increase in the amount of funding devoted to research and development, over £1.5 billion a year according to the most recent data. Companies which operate in the knowledge-intensive sector have begun to look for properties beyond the Tech City and other areas that traditionally had a strong presence of media and knowledge companies, such as Soho and London Bridge. New clusters have emerged in Stratford, Tottenham, and New Cross. These areas increasingly cater to the property requirements of small and medium-sized businesses, which made up 47% of all transactions during the first quarter of the year. The current floor space supply is set at 6.7 million square feet and vacancy rates average 6.9 per cent. The top rents achieved during this quarter reached £70 per square foot.

Office market availability has come under pressure due to the large number of commercial-to-residential conversions and to the significant level of commercial property being held as long-term assets. This is particularly the case in high-value areas where, for example, up to 80 per cent of the office floor space in Mayfair or St James, is locked up by investors.

In the West End, a sub-market traditionally occupied by companies in the media and creative industries, rents have reached average values of £80/sq ft in Fitzrovia and Soho although asking prices remain as high as £107.50/sq ft in other West End areas. In East London there has been high demand for co-working space from the TMT sector, especially in and around Old Street and in the EC2V postcode. The office development pipeline currently concentrates around the Olympic Park, a very attractive location for digital, advanced manufacturing, and life sciences occupiers. Overall, prime office rental values could increase by 6 per cent over the next two quarters, whereas rental growth in secondary locations is expected to remain stable.

“Lastly,” continued Katherine Aird, “according to researchers the office investment market shows that during February 2015 alone more than £160 million was poured into the market through seven large transactions, which involved the acquisition of office floor space in 1 Mabledon Place, 42-60 Kensington High Street, and 100 Knightsbridge, among others. Average prime yields are 3.25 per cent for offices in the West End and 4.25 per cent in the City.”

The Fight of the Century Draws Nearer

However, tickets have yet to be sold and there are only 11 days left until fight night. Bob Arum, Top Rank promoter, went on record to say that contracts remain unsigned due to a disagreement regarding signatories on the paperwork. It is this very back-and-forth that has driven demand for the fight to skyrocket, with fans anticipating and waiting for a fight for half a decade. Past delays were attributed to failure of both teams to agree on terms, including Pacquiao’s refusal to take a blood test on Mayweather’s terms.

The mega-fight comes at the perfect time, contrary to what others say, as both men are in their prime – more matured fighters who, because they were given the chance to learn more about their craft in the past five years. Analysts are expecting the fight to break previous records and it already has even before the fight has begun. Countless fans have booked reservations at nearby Las Vegas hotels, despite the absence of paper tickets.

Poverty Produces One Of The World’s Greatest Fighters

Even after some losses, Manny Pacquiao was unstoppably on his way to greatness and quickly became a worldwide favourite.

While Pacquiao entered the world of boxing to feed mouths, Floyd Mayweather hails from a family of boxers, albeit also growing up impoverished. Boxing was his release from a young life exposed to strife and drug addiction and absent parents. From the get-go, Money Mayweather was a defensive fighter, as his father had taught him. His tight defense kept him from acquiring scars, which is how he earned the nickname “Pretty Boy”. Mayweather’s amateur career at the 1996 Olympics, taking home the bronze. At his professional debut fight for the super featherweight division, he knocked out opponent Roberto Apodaca in two rounds, and analysts predicted Mayweather to become a world record holder. He is known to be a very strategic fighter who calculates his punches, resulting in less misses.

The Mayweather vs Pacquiao fight has been brewing for five long years, with negotiations spurring drug use rumors for the diminutive fighter, as Pacman refused to take the Olympic-style drug test on Mayweather’s terms. But analysts feel that the time is ripe for the fight to take place, when both boxers are more seasoned, and at their prime. Others argue that the fight is happening five years too late, as both near retirement age and have slowed considerably.

More Hurdles In Mayweather vs Pacquiao Fight

April 23, 2015 – – Just a few days before the most anticipated fight of the century, and it looks like there are some more hurdles to clear. Top Rank promoter Bob Arum has not signed the contract given to him by Mayweather Promotions on grounds that the draft did not adhere to initial agreements discussed and verbally agreed upon by both priorities. However, the opposite camp’s CEO, Leonard Ellerbe denies the allegations, stating that a contract was signed previously, but Arum was looking to find a way to alter the agreement.

Tickets have not gone on sale yet and closed circuit viewing are yet to be made available, which may be due to the lack of a signed agreement, as tickets for epic fights such as the Mayweather vs Pacquiao fights usually go on sale months in advance.

The delay in the official signing of the agreement is reported to be due to Mayweather Promotions looking for more tickets. In the draft recently sent to Arum, the Top Rank promoter complains that they were excluded as signatories, which implies less control for the Pacman team.

The five-year delay in a fight between the two powerhouse boxers was caused by half a decade of disagreements over fight agreements, from revenue division to drug testing disagreements.

Amidst the disagreements, both camps agree on one thing – that the fight of the century will take place and the fans will get what they’ve been waiting for. Ellerbe tells CNN, “Despite all of this, I’m confident the world will get to see the fight they’ve been waiting for.” While Arum asserts, They can’t do this type of subterfuge and keep their license. If they don’t do anything, the governor will step in and make this fight happen.”

Ringside seats are reported to sell for $US 45,352 for ringside seats. But, there is talk that no public sale will be made at all, leaving seats to be snatched up by celebrities, professional atheltes and stakeholders in the industry. At the minimum, only 1000 seats will be made avaialable to the public, if at all. To date, even without actual tickets in their possession, thousands of boxing fans have made their reservations to be at the center of fight night.

Recently, the emerald studded World Boxing Council championship belt costing $1 million was unveiled. The belt was uniquely designed in anticipation of the Fight of the Century, and won over an onyx belt that was also designed for the mega fight. Mayweather-Pacquiao Fight Assures A Goldmine For Both Boxers

Mayweather could not be more spot on when he said that the timing was perfect for the fight to take place.
